A landlord is always advised to obtain a guarantor (also known as surety) for every let they do. Ideally, the guarantor will be a homeowner.
This guarantee form is built into tenancy agreements produced by Tenancy Builder. To do so, select the guarantor option from the dropdown, enter the guarantor’s name and address, and allocate tenants to the guarantor (useful if there is more than one guarantor and multiple tenants).
For guarantees entered into on or after 1 May 2026, the Renters' Rights Act 2025 limits a guarantor's liability for rent attributable to any period from the connected tenant's death onwards, including the post-death portion of the rent period in which the tenant dies. Landlords using a guarantee on or after that date should use an up-to-date guarantor agreement and record the date the guarantee was entered into.
