Retrospective Assured Shorthold Tenancy Agreement
I have been asked to prepare a written AST tenancy agreement regards a tenancy which began a couple of years ago.
Can I provide a standard agreement reflecting what was agreed orally at the time but still referencing a 6-month fixed term, which has long since passed, with the agreement to be signed (and dated) by both parties very shortly?

These types of tenancies are governed by the statutory code set up in the Housing Act 1988, which was amended slightly by the Housing Act 1996. Today's vast majority of tenancies will be assured shorthold tenancies, and both assured and assured shorthold tenancy can charge a market rent for the property.
